What is the benefit to form a Section 8 Companies instead of a Trust or Society?

Section 8 company is registered by the Ministry of Corporate affairs, a Central Government Body and requires 2 members only and can do any social activity across India, While Trust and Society have a registration procedure at state level which is too complex as compared with Section 8.

Can a Section 8 Company make profits?

Section 8 companies do not aim to make profits but if earn profit then have to apply on the objects of the Section 8 entity.

Does a Section 8 Company need to file tax returns?

Annual Filling is mandatory for every company incorporated in India. The E-form filing along with the required documents must be filed with MCA.

Can foreigners invest in a Section 8 Company?

Yes, but subject to FDI approval by RBI.

Does it is mandatory to take 12A and 80G registration?

It is not necessary but All NGOs (be it a Trust, Society or Section 8 Company) must apply for 80G & 12A Certificate to provide Income Tax Deductions to the donors and itself availing exemption from paying income tax to the Income Tax Department by having 12A Certificate respectively.
